METHOD & TERMS


The land will be sold on a price per acre basis, based on surveyed acres. The tracts will be offered through the marketing method of “Buyer’s Choice”, whereas the high bidder can elect either or both tracts for their high bid. If the high bidder does not elect both tracts, then the remaining tract will be sold. The tracts will NOT be offered in their entirety at the conclusion of the auction.

Immediately following the auction, the successful buyer will be required to sign a real estate sales contract and pay ten percent (10%) of the purchase price as a non-refundable down payment which will be held in escrow until closing. The balance of the purchase price will be due at closing which will take place on or before Tuesday, April 21, 2026. Seller reserves the right to accept or reject any and all bids.

The seller will provide title insurance in the full amount of the purchase price and will pay all the 2025 taxes due in 2026 through a credit at closing based on the latest available information. Buyer will pay all the 2026 taxes and beyond. Open lease for 2026 crop year. Possession at closing.

REAL ESTATE TAXES UPDATE:

In the event that Buyer purchases both Tract 1 and Tract 2, then Seller shall pay the 2025 real estate taxes by giving Buyer a credit at closing, based on the most recent ascertainable tax assessment and tax rate. Buyer shall be responsible for the actual payment of all of the 2025 & 2026 real estate taxes, and all future years, when due and payable.

In the event that Buyer only purchases one Tract, then Seller shall escrow 110% of the 2024 real estate taxes with The Cantlin Law Firm, for payment of the 2025 real estate taxes, when due and payable. The parties shall enter into a Tax Escrow Agreement at the time of closing. Buyer shall be responsible for the 2026 real estate taxes, and all future years, when due and payable.

Bidding is NOT subject to any contingencies, including but not limited to financing, an appraisal or inspection of the property.
